This Agreement is a public contract (offer) between FOP NIKOLAIENKO S.K. (hereinafter referred to as the "Contractor") and any natural or legal person (hereinafter referred to as the "Customer").
1.1. The Contractor agrees to provide website development services based on the proprietary website foundation selected by the Customer from the Contractor’s catalog, and the Customer agrees to accept and pay for those services.
2.1. Standard projects require 100% prepayment. For projects priced at $1,200 or more, payment may be split into 50% upfront and 50% after the finished project is demonstrated.
2.2. Payments are made via bank transfer to the Contractor's account.
3.1. All services and digital products are delivered electronically via email or secure download link.
3.2. The delivery timeline depends on project complexity and is defined in the individual scope of work.
3.3. No physical goods are shipped.
4.1. Property rights to the created website are transferred to the Customer after full payment for the services.
4.2. The Contractor reserves the right to use the created materials in their own portfolio.
5.1. If work has not started and source code has not been delivered — 100% refund, no questions asked.
5.2. If work has started but source code has not been delivered — refund minus hours worked at $30/hour (hours are visible in your project tracker).
5.3. After delivery of the source code archive, refunds are not available because digital products can be copied. A 30-day technical warranty applies: we fix critical bugs in our code free of charge.
